By creating an account, accessing the Service, purchasing a paid membership, starting a free trial, or otherwise using the Service, you agree to be legally bound by these Terms. If you do not agree with these Terms, you must not use the Service.

1. Nature of the Service

MyBetterHalf.com is an online matrimonial and matchmaking platform intended to help individuals seeking marriage discover other users who may be compatible with their stated preferences and communicate with them.

The Platform is a self-service online platform. We do not provide personal matchmaking, marriage brokerage, counselling, proposal management, or human-assisted matchmaking services unless expressly stated otherwise for a particular service.

We provide technology and features that may include:

• User profiles and search/discovery functionality;
• Access to certain profile information;
• Sending and receiving proposals or expressions of interest;
• Messaging and communication features;
• Paid membership features;
• Free trials or promotional access;
• Other features that may be introduced from time to time.

We do not guarantee that your use of the Service will result in a response, proposal being accepted, communication, meeting, engagement, marriage, or any other particular outcome.

The Platform facilitates introductions only. Any relationship, communication, meeting, proposal, engagement, marriage, or other interaction between users occurs independently between those users.

2. Eligibility

You may not create an account on behalf of another person without their authorization.

3. Account Registration

You are responsible for maintaining the confidentiality of your account credentials and for all activity conducted through your account.

You agree to:

• Keep your information reasonably up to date;
• Not impersonate another person;
• Not create misleading or fraudulent profiles;
• Not share your password or account access with others;

You understand that information you choose to make available through your profile may be viewed by other users in accordance with the privacy and visibility settings available on the Platform.

You should not publish sensitive personal information that you do not wish other users to access.

5. Matrimonial Purpose

The Service is intended for individuals genuinely seeking marriage.

You agree not to use the Platform primarily for:

• Casual dating or relationships contrary to the stated purpose of the Platform;
• Harassment or unwanted communication;
• Financial solicitation;
• Fraud or deception;
• Advertising or commercial solicitation;
• Collecting personal information for purposes unrelated to marriage;
• Recruiting users to other websites or services;
• Any unlawful activity.

The Platform does not determine whether a particular user is suitable for marriage. Users are responsible for conducting their own due diligence.

6. No Guarantee of Matches or Results

IMPORTANT: Payment for a membership purchases access to specified Platform features. It does not purchase a guaranteed number of matches, proposals, responses, conversations, contacts, meetings, engagements, marriages, or any other result. We also do not guarantee that a particular number of users will be available in your preferred location, age range, education, profession, background, or other criteria. See Section 24 for a full list of outcomes we do not guarantee.

A paid membership provides access to the features specified for the applicable plan, subject to these Terms and the availability of the Service.

7. Paid Memberships

Certain features of the Service may require payment.

Before purchasing a membership, the applicable price, duration, included features, and other material terms will be presented to you.

By purchasing a paid membership, you authorize the applicable payment provider to process the stated payment.

Unless otherwise expressly stated, paid memberships are personal to the account that purchased them and cannot be transferred, sold, assigned, or shared with another person.

We may change membership prices or introduce, remove, or modify plans and features. Any changes to future subscription periods will be communicated or presented in accordance with applicable law.

8. Subscription Renewal and Cancellation

Where a membership is offered as a recurring subscription, the subscription may automatically renew at the end of the applicable subscription period unless cancelled before the next renewal.

You may cancel your subscription at any time through the cancellation functionality made available in your account.

Cancellation stops future renewal charges. It does not ordinarily terminate your already-paid membership period.

For example, if you purchase a one-month membership and cancel after ten days, your membership will generally remain active until the end of the already-paid membership period, but the subscription will not renew for another period.

You remain responsible for charges that have already been successfully processed, subject to any rights that cannot lawfully be excluded under applicable law. See Section 9 for our No Refund Policy.

9. No Refund Policy

All membership purchases are final once the paid membership has been activated, and we do not provide refunds, credits, partial refunds, or prorated refunds for unused membership time or unused features.

This includes, without limitation, situations where:

• You change your mind;
• You do not find a suitable match;
• You receive no proposals;
• You receive proposals but do not accept them;
• Other users do not respond to you;
• You do not use the membership;
• You use only some of the available features;
• You stop using the Service before the membership expires;
• You cancel your subscription after the payment has been processed;
• You become dissatisfied with the number or quality of available profiles;
• You find a spouse or otherwise no longer require the Service during the paid period.

Nothing in this section is intended to exclude or restrict any refund, cancellation, or other consumer right that cannot lawfully be excluded under applicable law.

10. Free Trials and Promotional Access

We may occasionally offer free trials or promotional access to eligible users.

Unless expressly stated otherwise:

1. A free trial is available only once per individual/member.
2. We may determine eligibility for a free trial using information associated with an account, email address, telephone number, device, payment method, or other reasonably available information.
3. Creating multiple accounts or otherwise attempting to obtain multiple free trials is prohibited.
4. We may refuse, cancel, restrict, or withdraw a trial where we reasonably believe that the trial eligibility requirements have been circumvented.
5. Free trials may provide access to only certain features of a paid membership.
6. Access to features during a trial may be limited, restricted, or pro-rated according to the applicable plan, feature, duration, or promotional offer.
7. Unless expressly stated otherwise, a free trial does not guarantee access to every feature of a paid plan.
8. We may modify or discontinue a promotional offer at any time, subject to applicable law and any terms specifically applicable to an already-started trial.

Where a trial converts into a paid subscription, the applicable conversion and renewal terms will be disclosed before or at the time of enrollment.

11. User-to-User Communication

The Platform may allow users to:

• View profiles;
• Access information made available by another user;
• Send proposals or expressions of interest;
• Accept or reject proposals;
• Send and receive messages;
• Exchange contact information where the relevant functionality permits.

We are not a party to communications between users.

Users are solely responsible for deciding whether, when, and how to communicate with another user.

We do not guarantee that:

• Messages will be read;
• Messages will be answered;
• Proposals will be accepted;
• Contact information will be genuine;
• Users will continue communicating;
• A user will behave as represented in their profile.

12. User Safety and Due Diligence

You acknowledge that online interactions involve risks.

You should independently verify information provided by another user before relying upon it.

We strongly recommend that users:

• Exercise appropriate caution when communicating with strangers;
• Verify identity and important personal information independently;
• Involve trusted family members or appropriate guardians where appropriate;
• Conduct appropriate background checks where necessary;
• Avoid sending money to another user;
• Avoid sharing passwords, financial information, identity documents, or other highly sensitive information unnecessarily;
• Take appropriate precautions before meeting anyone in person;
• Meet in safe and appropriate public environments when applicable.

We are not responsible for the conduct, representations, omissions, or actions of users before, during, or after their interaction through the Platform.

13. Fraud, Scams and Financial Requests

Users may not request, solicit, borrow, lend, transfer, or otherwise seek money or financial assistance from other users through the Platform for fraudulent, deceptive, or prohibited purposes.

If another user asks you for money, investment, loans, gifts, financial assistance, account credentials, verification codes, or other sensitive information, you should exercise extreme caution and report the activity to us.

We may suspend or terminate accounts that we reasonably believe are involved in fraud, scams, impersonation, financial exploitation, or other prohibited conduct.

However, we do not guarantee that every fraudulent account or fraudulent activity will be detected or prevented.

14. Prohibited Conduct

You must not use the Service to:

• Create a false or misleading identity;
• Impersonate another person;
• Misrepresent your marital status or other material information;
• Harass, threaten, stalk, intimidate, or abuse another user;
• Send spam or unsolicited commercial messages;
• Solicit money or financial benefits;
• Conduct scams or fraudulent schemes;
• Collect user information for unauthorized purposes;
• Copy, scrape, harvest, download, reproduce, or commercially exploit user information without authorization;
• Circumvent membership restrictions;
• Share paid account access;
• Attempt to obtain multiple free trials improperly;
• Reverse engineer or interfere with the Service;
• Introduce malware, viruses, or harmful code;
• Attempt unauthorized access to accounts or systems;
• Use automated bots, crawlers, scripts, or scraping tools without our written authorization;
• Use the Service for unlawful purposes;
• Engage in conduct that violates applicable law or the rights of others.

15. User Content License

You retain ownership of the User Content you submit to the Platform.

By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, display, transmit, and otherwise use that content to the extent reasonably necessary to operate, maintain, secure, improve, and provide the Service.

You represent that you have the necessary rights to grant this license.

We may remove or restrict User Content that violates these Terms, applicable law, or our safety policies.

16. Profile Moderation and Removal

We may, but are not obligated to, review, moderate, restrict, suspend, remove, or disable profiles, content, messages, or accounts where we reasonably believe there is a violation of these Terms, misuse of the Service, fraud, safety risk, legal issue, or other legitimate reason.

We do not undertake to manually review every profile, message, photograph, proposal, or piece of User Content.

The absence of moderation action does not constitute approval, verification, endorsement, or confirmation of any user's identity or statements.

17. Account Suspension and Termination

We may suspend, restrict, or terminate an account if:

• You violate these Terms;
• We reasonably suspect fraud or abuse;
• You provide materially false information;
• Your activity presents a safety, security, legal, or reputational risk;
• You misuse another user's information;
• You attempt to circumvent membership or trial restrictions;
• Your conduct harms the Platform or its users;
• We are required to do so by law; or
• We discontinue the relevant Service.

Where appropriate, we may provide notice or an opportunity to address the issue, but we reserve the right to act immediately where necessary to protect users, the Platform, or our legal interests.

Termination or suspension resulting from your violation of these Terms does not create an automatic entitlement to a refund.

18. Privacy

Your use of the Service is also subject to our Privacy Policy, which explains how we collect, use, store, disclose, and protect personal information.

Because matrimonial profiles may contain sensitive personal information, users should carefully consider what information they choose to publish.

Our Privacy Policy forms part of these Terms by reference.

19. Confidentiality of Other Users' Information

Information obtained through the Platform about another user is provided for legitimate matrimonial purposes only.

You may not sell, distribute, publish, reproduce, scrape, archive, or otherwise exploit another user's personal information without their authorization.

You must not use information obtained through the Platform to contact someone outside the intended purpose of the Service in a manner that is abusive, threatening, harassing, deceptive, or unlawful.

20. Third-Party Services and Payment Providers

Payments may be processed through third-party payment processors.

We do not control the systems, availability, security, policies, or practices of third-party payment providers.

Your use of a third-party payment service may also be subject to that provider's terms and policies.

We are not responsible for failures caused by third-party payment processors, banks, telecommunications providers, hosting providers, or other third-party services, except to the extent liability cannot lawfully be excluded.

21. Service Availability

We aim to keep the Service available and functional but do not guarantee uninterrupted, error-free, secure, or continuous availability.

The Service may occasionally be unavailable because of:

• Maintenance;
• Technical problems;
• Hosting or infrastructure failures;
• Cybersecurity incidents;
• Internet or telecommunications failures;
• Third-party service failures;
• Force majeure events;
• Legal or regulatory requirements; or

We may modify, suspend, or discontinue features or portions of the Service at any time, subject to applicable law.

22. No Professional or Human Matchmaking Service

Unless expressly stated otherwise, MyBetterHalf.com does not provide human matchmaking services.

No employee, representative, agent, matchmaker, relationship manager, or other person is assigned to personally find a spouse for you as part of a standard paid membership.

Paid membership provides access to the stated technological features of the Platform.

The purchase of a paid membership should not be interpreted as purchasing personal matchmaking, guaranteed introductions, or human-assisted marriage services.

23. No Warranties Regarding Users

To the maximum extent permitted by applicable law, the Platform does not warrant or guarantee the identity, age, marital status, religion, character, intentions, financial position, education, occupation, family background, location, photographs, statements, compatibility, or other characteristics of any user.

Any verification feature we may provide is a limited verification measure and does not constitute a guarantee of a user's suitability or trustworthiness.

24. Disclaimer of Guarantees

To the maximum extent permitted by applicable law, the Service is provided on an "as is" and "as available" basis.

We do not guarantee that:

• The Service will meet your individual requirements;
• The Service will produce a particular result;
• You will find a spouse;
• You will receive proposals;
• Your proposals will receive responses;
• Your communications will result in marriage;
• User information will always be accurate;
• The Service will always be available or error-free.

25. Limitation of Liability

To the maximum extent permitted by applicable law, MyBetterHalf.com, its owners, directors, officers, employees, agents, contractors, affiliates, subsidiaries, parent companies, licensors, service providers, business partners, and successors and assigns will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to your use of the Service.

This includes, without limitation, losses arising from:

• Interactions with other users;
• Reliance on information provided by users;
• Rejected proposals;
• Lack of responses;
• Failed relationships;
• Failed engagements or marriages;
• Fraudulent or misleading user conduct;
• Meetings or interactions between users;
• Unauthorized disclosure of information by another user;
• Temporary Service interruptions;
• Loss of data; or
• Your inability to use a feature.

Nothing in these Terms excludes liability that cannot legally be excluded or limited under applicable law.

26. Indemnification

To the maximum extent permitted by applicable law, you agree to indemnify and hold harmless MyBetterHalf.com, its owners, directors, officers, employees, agents, contractors, affiliates, subsidiaries, parent companies, licensors, service providers, business partners, and successors and assigns from claims, losses, liabilities, damages, costs, and expenses arising from or relating to:

• Your violation of these Terms;
• Your User Content;
• Your misuse of the Service;
• Your violation of another person's rights;
• Your unlawful conduct;
• Your interactions with other users; or
• Your breach of any representation or warranty contained in these Terms.

27. Intellectual Property

The Service, including its software, design, branding, logos, graphics, text, interfaces, and other original materials, is owned by or licensed to MyBetterHalf.com and is protected by applicable intellectual-property laws.

Except as expressly permitted, you may not reproduce, modify, distribute, sell, license, publicly display, reverse engineer, or commercially exploit any portion of the Service.

28. Reporting Abuse or Violations

If you believe that another user has violated these Terms, engaged in fraud, harassment, abuse, impersonation, or other prohibited conduct, you may report the account through the reporting functionality provided by the Platform or by contacting us at support@mybetterhalf.com.

We may investigate reports and take action at our discretion.

We do not guarantee that every report will result in removal, suspension, or another particular outcome.

29. Changes to the Service

We may add, modify, remove, suspend, or discontinue features of the Service from time to time.

Where changes materially affect paid services, we will provide notice where required by applicable law.

30. Changes to These Terms

We may update these Terms from time to time.

The updated Terms will be posted on the Platform with a revised "Last Updated" date.

Where required by applicable law, we will provide additional notice of material changes.

Your continued use of the Service after the effective date of updated Terms constitutes acceptance of the updated Terms to the extent permitted by law.

31. Electronic Communications and Agreement

You agree that electronic communications, notices, confirmations, acceptance of Terms, payment confirmations, and other electronic records may be used to establish your agreement and transactions with us, to the extent permitted by applicable law.

By selecting an acceptance checkbox, creating an account, purchasing a membership, or otherwise using the Service after being presented with these Terms, you acknowledge that you have read and agreed to them.

32. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the jurisdiction in which MyBetterHalf.com is registered, without regard to conflict-of-law principles, subject to any mandatory rights or protections available to you under applicable law.

Any dispute shall be subject to the exclusive jurisdiction of the courts of that jurisdiction, unless applicable law requires otherwise.

33. Severability

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision shall be enforced to the maximum extent permitted by law, and the remaining provisions shall continue in full force and effect.

34. No Waiver

Failure by us to enforce any provision of these Terms does not constitute a waiver of our right to enforce that provision later.

35. Entire Agreement

These Terms, together with the Privacy Policy and any additional terms expressly applicable to specific features or services, constitute the agreement between you and MyBetterHalf.com regarding your use of the Service.
